Bahrain courts to expand use of English language litigation

The Minister of Justice, Islamic Affairs and Endowments, Nawaf bin Muhammad Al-Maawda, issued an amendment to Resolution No. (117) of 2021 expanding the usage of the English language in courts and Bahrain Chamber for Dispute Resolution (BCDR).

 

 

This is in line with the Kingdom’s commitment to further develop commercial dispute resolution mechanisms through the use of English language in litigation proceedings, especially those related to commercial and financial cases.

 

 

The resolution stipulates that English language will be used in proceedings before BCDR in cases where the contract is in English and the dispute exceeds half million Bahraini dinars that are related to international trade, commercial banks and companies.

 

 

The resolution expanded the jurisdiction of English language courts to include all matters relating to arbitration if English language is used therein.

 

 

The resolution also stated that English language may be used upon agreement between parties in certain types of lawsuits identified in the schedule.
